Terms & Conditions
1. GENERAL
1.1 SAFRA Sprint Kids Best Recruit Challenge 2022 (“Event”) is organised by SAFRA National Service Association (“Organiser”) in accordance with these Rules & Regulations (“Terms”) that is applicable to the Participants, which can be found at www.safra.sg/ (“Official Website”).
1.2 Please read these Terms carefully before submission of online registration form. Completion and submission of the online registration form confirms your agreement to abide by the Terms of the Event.
1.3 By registering for the Event, you confirm that:
i. the information provided by you is true and correct;
ii. you consent to SAFRA's collection, use and disclosure of your personal data for the purposes of organising and managing the Event [including but not limited to contacting you via email and short message service (SMS) on the Event and transmitting your personal data to third parties engaged or working in collaboration with SAFRA (if applicable), and for other applicable purposes as set out in SAFRA's Privacy Policy (https://www.safra.sg/privacy-policy), as amended from time to time, which outlines how SAFRA manages your personal data in accordance with the Personal Data Protection Act 2012;
iii. where Personal Data of any third party is provided by you, you have obtained the consent of the third party to SAFRA’s collection, use and/or disclosure of those Personal Data.
iv. you are solely responsible for the personal data that you provide or disseminate, notwithstanding that the dissemination is via third party platforms, including but not limited to SAFRA’s Facebook page, and your personal data may also be subject to the personal data policies of such third party platforms.
v. photographs, videos and other recordings ("Media") will be taken by the Organiser at the Event. By attending the Event, whether as a participant, staff or volunteer, you consent to and grant the Organiser the right to use such Media for internal records purposes, publicity purposes, commercial advertising and distribution to its sponsors and partners.
1.4 The Participant agrees to: (i) provide true, accurate, current and complete information about the Participant required by the Organiser in the online registration form (the "Registration Data"); and (ii) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. To the extent permitted by law, the Organiser shall not be liable for any claim, demand, liability or action resulting from the Participant's omission, neglect and/or failure to supply the Organiser with the updated information and the accuracy and completeness of those information.
1.5 The Organiser may contact the Participant from time to time by email regarding event matters. Any notice sent to the email address registered with the Organiser shall be deemed as received by the Participant.
1.6 If the Participant provides any information that is untrue, inaccurate, not current or incomplete, or if the Organiser has grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Organiser may suspend or terminate the Participant's registration and refuse any and all future use of the Official Website (or any parts thereof). The Organiser shall not be held responsible for any disputes arising from incomplete entry details.
1.7 These Terms shall be governed by laws of Singapore, and the Participants and the Organiser agree to submit to the jurisdiction of the Singapore Courts.
1.8 The Organiser reserves the right to amend these Terms from time to time without giving prior notification or any reasons thereof.
2. REGISTRATION
2.1 Participants below 18 years of age need to seek parental or guardian consent before participating in the Event. The Organiser has the absolute discretion to reject and refuse the registration of a potential participant without assigning any reason to the participant, and to terminate such registration for any reason whatsoever.
2.2 The Organiser reserves the right to cancel or postpone the Event at any time. The Organiser may, but is not obliged to notify the Participants of such cancelation or postponement. If the Event has to be cancelled or postponed, there shall be no refund of registration fees paid and the Organiser shall not be liable for any other loss or inconvenience caused.
2.3 The Organiser reserves the right to set the fees for the different categories as expedient to its intents and purposes.
2.4 Once the online registration form has been processed, there will be no refund of registration fees for those Participants who eventually do not take part in the Event, for whatever reason.
2.5 Registration will only be confirmed upon successful payment. Registration without official payment being received is deemed invalid.
2.6 Each individual is allowed one participation per category.
2.7 Registration will not be accepted after the closing date of 23 Oct 2022, 2359hrs.
2.8 Upon successful registration, you are not allowed to change the category that you have registered for.
2.9 All category registrations are non-transferrable and non-refundable.
2.10 The Organiser reserves the right to close registration before the official closing date should participation reach its capacity.
2.11 The Organiser will not be responsible for any dispute arising from incomplete or incorrect information submitted by Participants.
2.12 Completion of the online registration form evidences the Participant’s agreement to abide by the Terms and Conditions of SAFRA Sprint Kids Best Recruit Challenge 2022.
2.13 The Organiser reserves the right to limit and refuse registrations/entries without assigning any reasons thereof.
2.14 The Organiser reserves the right to replace the challenge junior field pack items with items of similar value.
2.15 Participants shall be entered by their Parents / Guardians who will fill up the relevant indemnity and declaration forms as deemed necessary by The Organiser upon registration or in-person registration, failing which, The Organiser reserves the right to refuse entry to any participants.
3. CHALLENGE
3.1 The Organiser reserves the right to amend the requirements of the Event as they deem fit for the safety of the Participants and/or to prevent any potential hazards in the running of the Event, at any time without prior notice to the Participant. In such cases, every effort will be made to inform the Participant prior to the date of the event. The Organiser shall not be liable for any other loss or inconvenience caused due to such changes.
3.2 Participants below the age of 18 are required to seek parental/guardian consent and fill up the relevant indemnity form when registering online, failing which, the Organiser reserves the right to refuse entry to that Participant.
4. MEDICAL SAFETY
4.1 Whilst reasonable precautions will be taken by the Organiser to ensure the safety of Participants, Participants take part at their own risks and the Organiser, their sponsors and their appointed officials shall not be liable for any death or injury, loss or damage, suffered or otherwise, and howsoever arising.
4.2 The Organiser reserves the right to remove any Participant deemed physically incapable of continuing with the Event to prevent him/her from causing greater harm and injury to himself/herself.
4.3 Participants are strongly encouraged to go for a medical examination and/ or consult their medical practitioner prior to registration and before the actual event.
4.4 The parent or guardian of each participant is responsible for the child’s safety on the race day. It will be determined by each parent or guardian if their child is medically fit to run, ensure that the child can attend the event and will also be present to supervise the child.
4.5 A participant must retire from the race immediately if required to do so by any member of the official.
5. USE OF PERSONAL DATA
5.1 By visiting the Official Website, submitting the Participant's Registration Data onto the Online Registration Portal and/or participating in the Event, you confirm that
(a) the information provided by you is true and correct,
(b) you consent to SAFRA's collection, use and disclosure of your personal data for the purposes of organising and managing the Event [including but not limited to contacting you via email and short message service (SMS) on the Event and transmitting your personal data to third parties engaged or working in collaboration with SAFRA (if applicable), and for other applicable purposes as set out in SAFRA's Privacy Policy (https://www.safra.sg/privacy-policy), as amended from time to time, which outlines how SAFRA manages your personal data in accordance with the Personal Data Protection Act 2012;
(c) where Personal Data of any third party is provided by you, you have obtained the consent of the third party to SAFRA’s collection, use and/or disclosure of those Personal Data.
(d) you are solely responsible for the personal data that you provide or disseminate, notwithstanding that the dissemination is via third party platforms, including but not limited to SAFRA’s Facebook page, and your personal data may also be subject to the personal data policies of such third party platforms.
5.2 The Organiser may disclose Registration Data without notice, only if required to do so by law or in the good faith belief that such disclosure is deemed necessary to the Organiser.
5.3 All reasonable efforts are made by the Organiser to ensure that any Registration Data held by the Organiser is stored in a secure and safe place.
5.4 Photographs, videos and other recordings (“Media”) will be taken by the Organiser at this event. By attending this event, whether as a participant, staff or volunteer, you consent to and grant the Organiser the right to use such Media for internal records purposes, publicity purposes, commercial advertising and distribution to its sponsors and partners.
5.5 Please note that non-official photographers might also operate at this event. SAFRA has no control over and is not responsible in any way for any Media produced by non-official photographers.
5.6 Social Media Contest
(a) Social media contest(s) (“Contest”) related to the Event will be organised.
(b) By participating in this Contest, you consent to SAFRA’s collection of your personal data in order to conduct the Contest and agree that SAFRA may, for this purpose, collect, use and/or disclose your personal data in accordance with these Terms and Conditions and SAFRA’s Privacy Policy at, https://www.safra.sg/privacy-policy.
(c) You are solely responsible for the personal data that you provide or disseminate, notwithstanding that the dissemination is via third party platforms managed by SAFRA, including but not limited to SAFRA’s Facebook and Instagram pages, and your personal data may also be subject to the personal data policies of such third party platforms.
(d) With respect to your information, you warrant and represent to SAFRA that any information provided by you which will include your personal data (or any materials contained therein): (i) shall not be false, inaccurate, or misleading; (ii) shall not be fraudulent, inaccurate, incorrect, or untrue; (iii) shall not infringe any third party’s copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy; (iv) shall not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising); (v) shall not be defamatory, libellous, offensive, unlawfully threatening, or unlawfully harassing; (vi) shall not be obscene or contain child pornography or anything adult in nature or harmful to minors; (vii) shall not contain any viruses, Trojan horses, worms, time bombs, cancellous, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information; (viii) shall not create liability for SAFRA or cause SAFRA to lose (in whole or in part) the services of SAFRA’s ISPs or other suppliers; (ix) shall not contain materials that are religious and political. Furthermore, you may not submit any information (including your personal data) on the SAFRA Website or SAFRA’s Facebook Page that could cause SAFRA to violate any applicable law, statute, ordinance, or regulation.
(e) You hereby grant SAFRA a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to use and to exercise the copyright and publicity rights you have in your information and materials submitted by you for the Contest (“submission”), in any media now known or not currently known, with respect to your information.
(f) You shall not assume a false identity or the identity of any other party or transmit libellous, harassing, vulgar, or otherwise objectionable messages; or post materials subject to copyright or other intellectual property rights claimed by any third party.
5.7 COVERAGE
(a) Each participant, in participating in the Contest: (i) agrees to take part in any and all marketing, promotional, publicity exercises with respect to the Contest; (ii) agrees for SAFRA to use his/her name, voice, photograph, likeness or other personal identifiable information in any media for the promotion and publicity of the Contest and/or SAFRA products; and (iii) grants to SAFRA all consents and waivers necessary hereunder, including in respect of any promotional photographs and/or audio/ video recordings taken in respect of the Contest
(b) Each participant agrees that SAFRA shall be at liberty to publish, promote, copy, reproduce, transmit, display, edit, adapt, modify, create derivative works of and/or otherwise distribute or use his/her particulars (including any publicly available Instagram or Facebook profile photo and details) and/or the submissions (or any part thereof): (i) in connection with the Contest and/or SAFRA products; (ii) for the promotion and publicity of SAFRA events and/or SAFRA products; (iii) in any manner, format or media whether now known or hereinafter created, and in any part of the world, including without limitation on online platforms such as Facebook, Instagram, Twitter, and YouTube; (iv) at SAFRA's sole and absolute discretion; and (v) royalty-free and without any obligation of attribution or consent.
(c) For the avoidance of doubt, SAFRA expressly reserves the right to adapt, edit and/or modify each submission to include any logo, branding, name, mark, product image in respect of any submissions or such derivative work thereof, for any promotional or marketing purposes of SAFRA branding and/or products.
6. DISCLAIMER; LIMITATION OF LIABILITY
6.1 The Organiser represents or warrants that the online registration portal and/or the Official Website will always be available and meet the Participant's requirements, that access will not be interrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to the Participant's equipment including computer, tablet or mobile phone. The Participants have sole responsibility for providing adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for viruses or other destructive properties.
6.2 Without limiting to the foregoing, all information and materials contained in the online registration portal and/or Official Website are provided on an "as-is" basis. The Organiser assumes no responsibility and shall not be liable (to the extent permitted by law) for any damage or injury arising out of your registration and participation in the Event or access to the online registration portal and/or Official Website, or any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, interception of online communication, software or hardware problems (including without limitation loss of data or compatibility problems), whether for breach of contract, tortious behaviour, negligence or under any other causes of action.
7. WAIVER AND INDEMNITY
7.1 By using and accessing to the online registration portal and/or the Official Website, and by taking part in the Event, the Participant agrees, to the extent permitted by law, to indemnify and hold the Organiser, its directors, employees, sponsors, agents, and third party service providers harmless with respect to any claims arising out of your breach of these Terms, your use of the hybrif registration portal or any action taken by the Organiser as part of its investigation of a suspected violation of these Terms or as a result of its finding or decision that a violation of these Terms has occurred. This means that the Participant cannot sue or recover any damages from the Organiser, our directors, employees, sponsors, agents and third party service providers as a result of the Organiser's decision to remove or refuse to process any information or content, to warn you, to suspend or terminate your registration or your participation in the race, or to take any other action during the investigation of a suspected violation or as a result of the Organiser's conclusion that a violation of these Terms has occurred, to the extent permitted by law. This waiver and indemnity provision applies to all violations described in or contemplated by these Terms.
8. EVENT MECHANICS
8.1 Participant(s) are to report at their respective venues and time slots as selected during registration.
8.2 Participant(s) will need to produce their birth certificate or Student card for verification purposes if requested by the officials. The Organiser reserves the right to refuse participation for participants(s) who fail to produce proper identification.
8.3 Participant(s) will need to queue up for their turns in the warm-up zone. Participant(s) who leave the queue is to re-queue again as reservation of turns are not allowed.
8.4 Participant(s) will be required to do their own proper warming up or stretching exercise at the warm-up area before their turn to compete.
8.5 Participant(s) will be allocated to their respective lane by the official onsite. Participants(s) are not to deviate from the game stations for any reason unless the official onsite authorises them to do so.
8.6 Participant(s) are to start doing the activity at each station once the official gives them the cue. If a participant starts before the signal given, a false start will be given. A participant who has three false starts will be automatically disqualified from the sprint and no refund will be given.
8.7 No form of any wheel-run objects of transports e.g. inline skates, prams or shoes with built-in or attached rollers is allowed on the sprint track at all times. Participant(s) will be disqualified instantly.
8.8 Sprint Kids Best Recruit Challenge 2022 Official’s timing and scoring is final. The Organiser reserves the right to the final say on the timing and scoring.
8.9 All participants will be informed via email on the event details nearer to date.
8.10 Decision of scores for each game station is determined by the respective game station masters in accordance to the game rules for each game station. Organiser’s decision of the scores is final.
9. EVENT RULES
9.1 All participants are to register themselves with a valid identification document which includes Identification Cards, Passports or Student Passes.
9.2 All participants are to wear proper running shoes. Sandals, slippers, open-toed shoes and other forms of footwear are not allowed on the course at all times.
9.3 Participants are to observe discipline at all times and follow the instructions of Officials and Marshals. Any damage to the course due to misconduct may result in the participant being disqualified from the event.
9.4 Participants can only enter the challenge course when called upon. Venturing, trying or any other forms of entry into the course is not permitted and may result in an instant disqualification of the participant.
9.5 Participants would need to wait for the signal from the official to start the activity. If a participant were to start before the signal is given, it would be considered as a false start. The participant will be automatically disqualified if they incur a 4th false start.
9.6 Participants are to attempt ALL activities. Failure to attempt the obstacle(s) may result in the participant being disqualified from the competition.
9.7 Assistance from parents is not allowed (except in Parent and Child Category). Unauthorised assistance will result in a disqualification of the participant.
9.8 Officials reserve the right to assist participants in times of need. However, discretion will be used and assistance will be given only in absolute need. Depending on the situation, a penalty will be added to the total score for each assistance provided.
9.9 Any protest during the course of the competition has to be filed with a proper protest form and a deposit of $100. Should the protest be deemed valid after an official investigation, the deposit will be refunded.
9.10 Protests can only be filed during the time the competition for that particular category is in place. Protests after the allocated time will not be accepted.
9.11 The Organiser reserves the right to shorten, modify, swap the challengess, postpone or cancel the event due to conditions such as but not limited to:
- Inclement Weather;
- Force Majeure;
- Haze and
- Other conditions that may interfere with the conduct of the event.
9.12 There will be NO refund of registration fees if the participant(s) is disqualified from the competition.
9.13 The decision of The Organisers and its appointed officials are final.
